High Court issued Notice to Delhi Government over Nursery Admission Age
In a petition by NGO Social Jurist, the Delhi High Court on 2 November 2011 issued notice to Delhi Government for disallowing the nursery admission of children below four years of age in Capital's unaided schools.
The petitioner NGO through its counsel Ashok Agarwal had filed a Public Interest Litigation (PIL) in the Delhi High Court, to prevent unaided recognized private schools of Delhi from admitting children below four years of age. A division bench of Acting Chief Justice AK Sikri and Justice Rajiv Sahai Endlaw, on hearing the matter, sought a reply from the Delhi Government by Nov 23.
The petition was filed in violation of 2007 court order and the recommendations of the Ashok Ganguly committee that directed the Government to fix four years-plus as the age criterion for admission to pre-primary class.
The petition also conferred that the state's inaction violated the fundamental rights of children, the provisions of Delhi School Education Act, 1973 and Right of Children to Free and Compulsory Education Act, 2009.
